TERMS AND CONDITIONS – VOTRE LOUIS ONLINE STORE

2. DEFINITIONS
Store – the Seller’s e-commerce service available at www.votrelouis.com
Client – a consumer, an entrepreneur acting as a consumer (EAC), or a business.
Goods – handmade furniture and accessories; also “made-to-order” and “customized”.
Business days – Mon–Fri excluding public holidays in Poland.
3. GENERAL PROVISIONS
The Store sells to EU countries (except Poland) and selected third countries (including the USA).
Products are artisanal – minor differences in color/grain and dimensional tolerances of ±1–2 cm are possible.
Prices are quoted in USD/EUR/GBP; for deliveries outside the EU, the price does not include import duties/taxes unless stated otherwise.
For price reductions, we inform about the lowest price from the last 30 days (OMNIBUS Directive).
Reviews are published only after purchase verification – rules set out in § 16.
The Terms and Conditions are available free of charge in a format enabling download and storage.
4. ORDERS AND CONTRACT FORMATION
Orders may be placed 24/7; the contract is concluded once confirmed by the Seller via e-mail.
The Client provides accurate data and selects delivery and payment method; invoices issued upon request.
For made-to-order products – a contract for specific work: production starts after full payment.
The Store archives the contract in the system for as long as needed for execution and settlement.
5. CLIENT ACCOUNT
Account creation is voluntary and free of charge.
The Client is responsible for confidentiality and updating login data.
6. PAYMENTS
Methods: STRIPE fast payments/cards, bank transfer; currencies: USD/EUR/GBP.
No payment within 7 days – order cancellation.
7. DELIVERY, RECEIPT AND RISK
Carriers: DHL/UPS/FedEx; delivery to address or collection point.
Deliveries to the USA – default Incoterms® 2020: DAP (Delivered At Place); the Client as importer covers duties/taxes at clearance. DDP option available upon request.
Importer of record (USA): the Client or their broker; the Seller provides customs data (goods description, value, CN/HTS code, country of origin, wood species).
Delivery times are indicative; customs clearance delays do not constitute improper performance.
Upon receipt, we recommend checking the shipment and writing a damage report in case of issues.
8. MADE-TO-ORDER PRODUCTS
Products are created per the accepted specification; changes after acceptance may be paid or impossible.
Placing an order equals acceptance of the specification.
Natural differences in wood and dimensional tolerances are not defects within declared tolerances.
9. RIGHT OF WITHDRAWAL (RETURNS)
EU consumers and EAC – 14 days to withdraw from a distance contract without reason.
Exclusions: non-prefabricated, made-to-order, customized products, and others provided by law.
Non-EU Clients (e.g., USA) – voluntary 14 days to return ready-made products (not custom).
Returns to Poland; Client covers return costs and import duties.
Refunds without undue delay, no later than 14 days after withdrawal notice; may withhold refund until receiving goods/proof of dispatch.

10. EXCHANGE
Subject to availability, we offer exchange (same procedure as withdrawal) unless otherwise agreed.
11. COMPLAINTS (WARRANTY / NON-CONFORMITY)
Report: e-mail with defect description, date, photos, and order number – Annex 2.
Priority: repair or replacement; if impossible – price reduction or withdrawal.
Return transport: after preliminary verification – return label/collection (EU) or clearance instructions (USA).
Natural wood features (knots, grain differences, minor movement) are not defects within tolerance.
12. ENTREPRENEUR ACTING AS CONSUMER (EAC)
Provisions for Consumers apply accordingly to EAC, unless the purchase is strictly professional.
13. PRICES, PROMOTIONS AND TRANSPARENCY (OMNIBUS)
In case of reduction, we display the lowest price within 30 days before promotion (or since sale start – if shorter).
Promotion rules (duration, restrictions) are described in the offer.
No “hidden costs”; for DAP (USA) we inform that duties/taxes are not included in the price.
14. COPYRIGHTS AND DESIGNS
Product photos, descriptions, and designs are protected. Commercial copying is forbidden without Seller’s consent.
15. REVIEWS AND VERIFICATION
Reviews published after purchase verification – one-time link tied to order number.
Reviews obtained otherwise are marked “unverified”.
We moderate only obvious spam, profanity, personal data, or dangerous links.
Personal data processing related to reviews is governed by our Privacy Policy.
16. PERSONAL DATA AND COOKIES
Data controller: Seller (“Controller”).
Details on data processing – rules, legal bases, retention periods, and cookies description – are in the Privacy Policy (section “Cookies, analytics, and server logs”).
The Store uses necessary cookies and – with consent – analytical/statistical cookies; marketing cookies only with prior consent.
17. GOVERNING LAW AND DISPUTE RESOLUTION
Polish and EU law applies; this does not deprive Consumers of protections in their country of residence.
We aim to resolve disputes amicably; Consumers may use mediation at Trade Inspectorate or consumer ombudsmen (ADR).
EU ODR platform closed on 20.07.2025; in case of disputes, please contact us directly or use national ADR.
18. CHANGES TO THE TERMS AND CONDITIONS
Changes take effect from the date set by the Seller, not earlier than 14 days after publication; for prior orders the previous version applies.
19. FINAL PROVISIONS
Store content constitutes an invitation to contract; photos may differ from reality due to screen settings and natural material differences.
